D É C I S I O N

[1] La locatrice a produit au Tribunal administratif du logement une demande de résiliation de bail, exécution provisoire de la décision malgré l’appel et paiement des frais judiciaires.
[2] Les parties conviennent de l'entente suivante, laquelle est présentée à l’audience :
« WHEREAS the landlord has filed a demand ta cancel the lease and evict the tenant with the Tribunal administratif du logement, which bears the number 622271 dated March 25th 2022;
WHEREAS the tenant admits having received the said demand;
WHEREAS the tenant admits that the demand of the landlord is well founded;
WHEREAS the parties wish to settle the present matter amicably;
CONSEQUENTLY, THE PARTIES AGREE AS FOLLOWS:
- The preamble forms an integral part of this agreement;
- The tenant shall use his dwelling with prudence and diligence and shall maintain it in clean condition, at all times;
- The tenant shall give full access to his dwelling to all representatives of the landlord in order for them to ascertain the condition of the dwelling or perform the required treatments to eradicate vermin, with a prior notice of 24 hours, in accordance with section 1931 of the Civil Code of Quebec. However, in case of an emergency, the tenant shall provide access to his dwelling to all the landlord's representatives, at any time;
- The tenant shall collaborate with all representatives of the landlord and with the exterminators;
- The tenant shall ensure that his dwelling is adequately prepared for the required treatments of vermin, in accordance with the instructions of the landlord and/or the exterminators;
- The tenant shall notify the landlord, within a reasonable time frame, of any new presence of vermin in the dwelling;
- It is understood and agreed that in case of non-compliance with one or more of the above mentioned engagements, the Iandlord may apply to the Tribunal administratif du logement to ask for the termination of the lease and the eviction of the tenant according to the provisions of the Civil Code of Québec.
- Considering the fact that the tenant is currently on a waiting list for a transfer, it is understood that the present agreement is valid for any dwelling rented by the tenant to the landlord;
- The tenant gives the landlord a final and total release for all past or present recourses relating to the presence of vermin in the dwelling located on [...], apt. # 6 in Montréal;
- The tenant acknowledges having read this consent, having understood its scope and have been advised of the importance of respecting those engagements;
- The parties agree that this agreement be part of a judgment and homologated by the Tribunal administratif du logement in their absences;
- The present agreement was drafted in English, as it is the language of the lease; »
POUR CES MOTIFS, LE TRIBUNAL :
[3] ENTÉRINE l'entente intervenue entre les parties, la DÉCLARE exécutoire et ORDONNE aux parties de s'y conformer.
