D É C I S I O N

[1] La locatrice demande l'exécution en nature des obligations de la locataire et subsidiairement la résiliation du bail, l'exécution provisoire de la décision malgré l’appel et les frais.
[2] À l'audience, les parties conviennent de l'entente suivante :
« Transaction (Settlement)
Whereas Parties decided to settle their problems and disputes in an amicable way;
Whereas the lessor is also the owne of the Dwelling unit ;
Whereas Parties have a lease that is currently in force
Parties agreed to the following
- Lessor agrees to allow the Lessee to sublet for a minimum of 30 days periods;
- Lessor will pay the amount of 2900,00 $ (two thousand nine hundred dollars) to Lessee by bank draft or etransfer, 1450,00 $ being paid on December 17th, 2019 and 1450,00 $ (balance) being paid on March 31st, 2020;
- Lessee will leave the Dwelling unit on March 31st, 2020 or before as she decides ;
- Lessee, if she decides to leave before March 31st, 2020, will send an email confirming the date of her intended departure and at least 5 days before said date;
- Lessee and Lessor agree that Lessee will not pay any rent for January, february and March 2020;
- Lease will be terminated on March 31st 2020;
- Parties grant each other full, final, complete and irrevocable release concerning all future present and past claims they could have against each other concerning the Dwelling unit, except gross or intentional negligence related to the physical condition of said dwelling
- This is a Transaction pursuant to Section 2631 and following of Civil Code of Québec; » (sic)

POUR CES MOTIFS, LE TRIBUNAL :
[5] ENTÉRINE l'entente intervenue entre les parties, la DÉCLARE exécutoire et ORDONNE aux parties de s'y conformer.
