D É C I S I O N

[1] Le 28 décembre 2011, la locatrice produit à la Régie du logement une demande de résiliation de bail, d’éviction du locataire et d’exécution en nature des obligations de ce dernier.
[2] À l’audience, les parties conviennent de l’entente suivante :
« AGREEMENT
WHEREAS the landlord has filed a demand to cancel the lease and evict the tenant with the Régie du logement;
WHEREAS the tenant admits having received the said demand;
WHEREAS the landlord and the tenant wish to enter into an agreement as
described hereunder and substitute an order to comply under section
CONSEQUENTLY THE PARTIES AGREE AS FOLLOWS;
1. The preambule forms an integral part of this agreement;
ORDER the Tenant to keep his dwelling uncluttered at any time;
ORDER the Tenant to collaborate with all employees of the Landlord and he shall let the employees of the Landlord visit his dwelling at all time when a prior notice of 24 hours is given; the Tenant specifically states that he usually returns to China for a period of approximately one month every year; for the duration of this Agreement, he will advise the Landlord of such absences beforehand and the Landlord acknowledges that it will not be able to visit his dwelling during this period of absence, unless there in an urgent need to do so;
2. Should the tenant disrespect a disposition of the present agreement, the landlord may introduce a demand with the Régie du logement cancel the lease and evict the tenant;
3. The parties agree that the agreement be part of a judgment to be rendered by the Régie du lodgement;
4. The parties renounce to their right of retraction or appeal of the judgment to be rendered by the Régie du lodgement;
5. The above mentioned dispositions shall enter in force at the time of acceptance and signature of this agreement and shall be maintained in force until December 31st 2015;
6. The present agreement was drafted in English as it was the wish of the tenant. »
[3] CONSIDÉRANT que l’original de cette entente est consigné au dossier;
[4] CONSIDÉRANT l’article 14 du Règlement sur la procédure devant la Régie du logement;
POUR CES MOTIFS, LE TRIBUNAL :
[5] ENTÉRINE l’entente intervenue entre les parties, ORDONNE aux parties de s’y conformer selon ses conclusions et la DÉCLARE exécutoire immédiatement.
