D É C I S I O N

 

 

[1]         La locatrice demande la résiliation du bail et l'expulsion des locataires, le recouvrement du loyer (4 668,20 $) ainsi que le loyer dû au moment de l'audience, plus les frais.

[2]         À l'audience, les parties conviennent de l'entente suivante :

«TRANSACTION AGREEMENT

WHEREAS Martello is the owner of the property Iocated at [...], Montreal, Quebec, [...] (the "Property");

WHEREAS Tenant occupied the Property under a lease signed July 18, 2021 up until April 30th, 2022; (the "Lease")

WHEREAS on April 25, 2022 Martello filed a demand at the Tribunal Administratif du Logement to terminate the Lease and claim arrears of rental (the Demand");

WHEREAS to this day, Tenant owes arrears of rental totalling $4.668.20 and the parties have agreed to settle all matters resulting from the Lease and the termination thereof;

WHEREFORE the parties agree to settle the Demand in an out of Court manner under the following terms and conditions:

  1. The parties agree that the Lease is terminated as of April 30, 2022;
  2. Dorel shall pay Martello a total amount of $3,800.00 for arrears of rental as well as an amount of $113.80 for bailiff fees, said amounts to be paid in consecutive monthly instalments as follows:

- a first payment of $1,063.80 by no later than June 2, 2022;

- a second payment of $950.00 by no later than July 15, 2022;

- a third payment of $950.00 by no later titan August 12, 2022;

- a fourth payment of $950.00 by no later than September 23, 2022.


  1. The said payments shall be made by cheque and must be delivered to Martello on or before the due dates. Dorel will be charged $50.00 for any cheque returned for insufficient funds or stop payment.
  2. Should Dorel default on any of the said payments when due, she shah automatically lose the benefit of the term and all then remaining instalment payments shall become irnmediately due and payable;
  3. Upon full payment of all sums being made to Martello, the parties will be deemed to have given themselves a mutual receipt release and discharge of ail claims, suits, demands or recourses of whatsoever nature or kind that they may have or pretend to have, one as against the other, for the past, present or future and whether directly or indirectly related to the Lease, the termination thereof or any facts or exhibits filed in the present matter;
  4. The parties agree that the present agreement constitutes a Transaction in accordance with articles 2631 and following of the Civil Code of Quebec;
  5. The parties agree that the present Transaction be ratified in a decision of the Tribunal Administratif du Logement and agree and undertake to sign the necessary forms to ensure this;
  6. The parties have agreed and requested that the present agreement be drafted in English. Les parties ont convenu et accepte que la présente Transaction soit rédigé en Anglais. »

POUR CES MOTIFS, LE TRIBUNAL :
