D É C I S I O N

 

 

[1]      La locatrice a produit à la Régie du logement une demande en résiliation de bail, exécution provisoire malgré l’appel et paiement des frais judiciaires.

[2]      À l'audience, les parties conviennent de l'entente suivante :

« CONSENT TO JUDGMENT

Whereas the landlord has filed a demand to cancel the lease and evict the tenant with the Régie du logement, which dears the number 346582, dated july 12th 2017;

Whereas the tenant received the said demand;

Whereas the landlord and the tenant wish to enter into an agreement as described hereunder and substitute to the resiliation of the lease an order in accordance with article 1973 of the civil Code of Quebec with the following conclusions :

Order the tenant to use his dwelling with prudence and diligence and to keep it clean in accordance with article 1911 of the civil Code of Quebec;

Order the tenant to not use any insults towards the landlord’s representatives and/or the exterminators, and not to be agressive towards them;

Order the tenant to give full access to his dwelling to the landlord and the exterminators, with a prior notice at 24 hours, in order for them to carry out the necessary treatments until the extermination of the cockroaches is completed with success :

Order the tenant to collaborate with all landlord’s employees and the exterminators mandated by them and to let them visit his dwelling in order to proceed with an inspection;

Order the tenant to adequately prepare his dwelling for the treatments agaist vermin in accordance with the instruction and requirements given by the exterminators and/or the landlord;


Noterbly :

- empty and clean all kitchen cupboards and counters

- empty and clean the bathroom cupboards

- dispose of all waste, empty bottles, used containers, insecticides and cupboards

- clean all greasy surfaces (stove exterior, adjacent walls, etc.)

- do not use insecticides

- do not leave any food on the cupboards, the table, the floor and on the racks, and put all your food in the fridge or in closed jars.

Order the tenant to notify the landlord, within a reasonable time frame, of any situation that may pose a risk or a threat for the effectiveness of extermination procedures already compleated and/or to be completed in the dwelling;

Order that the above-mentioned dispositions shall enter in force at the time of acceptance and signature of the agreement and be valid for all dwelling located by the tenant to the landlord for a period of (3) three years;

Should the tenant disrespect a disposition of the present agreement, the landlord can introduce a demand with the Régie du logement to cancel the lease and evict the tenant, in accordance with the provision of the civil Code of Quebec;

The parties agree that the agreement be part of a judgment to be rendered by the Régie du logement;

The parties renounce to their right of judicial review, revocation or appeal of the judgment to be rendered by the Régie du logement;

The whole, without cost; » (sic)

POUR CES MOTIFS, LE TRIBUNAL :

[3]      ENTÉRINE l'entente intervenue entre les parties, la DÉCLARE exécutoire et ORDONNE aux parties de s'y conformer.
